Domestic Assault, Sexual Assault, Criminal Harassment, Threat and Violent Crimes

Acrimonious family law litigation provides ulterior reasons for complainants to make criminal allegations. You have to understand how to turn these parallel proceedings to your advantage. The best way is to access your family file for any evidence that might undermine your ex's credibility or provide a reason to fabricate. Here are two examples.

• R v. Mountasouris (2007):
Mr. Mountasouris's spouse did not count on me researching her allegations in her family court files that she had called the police on my client on several prior occassions. His Honour disbelieved the spouse enabling Mr. Mountasouris to attack his Ex's allegations in their family court matter.

• R v. Stefoff (2006):
Once again, Mr. Stefoff's spouse never counted on me cross-examining her on an affidavit she filed in family court that contradicted what she told the police. In the strongest of judicial language I have ever heard, the trial judge came as close to calling the Ex, as she could, a liar. Mr. Stefoff successfuly used the judge's commnents in winning back access to his children.

• R v. Dobson (2007):
Save your e-mails! Mr. Dobson's girlfriend forgot about all those angry e-mails she had sent him, but the computer didn't. I asked Ryan, my computer expert, to recover them. It didn't take long after that for His Honour to aquit Mr. Dobinson of criminal harassment.

Internet and Computer Crime

• R v. Baker (2006):
Mr. Baker was charged with criminal defamation for posting naked pictures of his ex-girlfriend, that she had sent to him of herself from the waist up, on the Internet after she unceremoniously dumped him. The charges were wisely withdrawn by a senior Crown when I showed him photographs the girlfriend had posted on her own webpage of herself half-topless covered in blood trying to stab her own eye with a syringe.

Drug Offences

• R v. Brown (2005):
After four days of deliberations, the jury could not convict Mr. Brown on a count of importation based on the evidence of a known drug runner. This case illustrates how important is is to make sure the jury is aware of the criminal antecedents of star Crown witnesses.

White Collar Crime

• R v. Stewart (2006):
It is important to put the defence case to Crown witnesess in your cross-examination. No bank employee or government official said Mr. Stewart was present when his wife filled out various documents and applications. The Court found that there was insufficient evidence to prove that Mr. Stewart knew about his wife's fraudulent activities.

Driving Offences, Impaired Driving/Over 80, Dangerous Driving, Careless Driving

• R v. David (2006):
Charge of Over 80 withdrawn at trial affter Charter Application alleging s.10(b) right to counsel violation was successful and the readings were excluded.

• R v. Pollanov (2005):
Charge of Impaired Driving withdrawn prior to trial after resolution meeting with Crown. There were no reasonable and probable grounds to arrest Ms. Pollanov to begin with. She was changing a flat tire and admitted to a police officer, who stopped to assist, that she had consumed a shot of vodka sometime during the evening. There was no connection between her driving and a flat tire.
